APC NWC AFFIRMS OKOCHA LED 7-MAN COMMITTEE AS AUTHENTIC.

Deputy National Secretary of APC, Barr. Festus Fuanter said that Emeka Beke who was reinstated by a Rivers State High Court had already been sacked by another court.

Following the judgement of the Rivers state High Court, delivered by the Hon. Justice Sika H. Aprioku on August 12,2024, that sacked Hon. Okocha Caretaker Committee of the All Progressive Congress ( APC) in RIvers State, the National Working Committee of the APC, said that the Okocha led Caretaker Committee Remains The Authentic and Recognized State Working Committee ( SWC) in RIvers State.

This was disclosed by the National Working Committee ( NWC) of the All Progressive Congress on Thursday August 15,2024, in Abuja, after the NWC meeting, saying that Chief Tony Okocha -led Caretaker Committee of the party in RIvers state, remained the recognized administrative body of the All progressive congress in RIvers state.

This was as Rivers State High Court on Monday August 12,2024, sacked Chief Okocha’s -led caretaker committee and reinstated Emeka Beke as Chairman.

Earlier, while addressing journalists, Deputy National Secretary of APC, Barr. Festus Fuanter said that Emeka Beke who was reinstated by a Rivers State High Court had already been sacked by another court.

Fuanter stated Beke had had later filed an appeal, but he could not wait for the outcome of his appeal before he embarked on an abuse of court processes.

Fuanter’s word,’ “We want to categorically state and inform the public that the position of the party, the All Progressive Congress in the judgement delivered by the RIvers High Court by Justice H Aprioku in Suit No: PHC 3592 CS, 2023 wherein the Court reinstated the dissolved State Executive Committee that it is not binding on the party ( APC)”

According to him, the claimant in the said case sued the National Chairman and Secretary of the All progressive congress and not the party itself, pointing out that an agent of a disclosed principal cannot be sued, even as he opined that a Court Judgement/ Ruling/ Order is not binding on a person or organization that is not a party to the suit.

He further stated that “In suit no. PHC/ 3592/ CS/ 2023 between Sam EtetegwungVs His Excellency,Abdullahi Ganduje&7 others wherein the Court reinstated the Rivers State Executive Committee earlier dissolved by APC, is not binding on APC, because, it was not joined as a party in the suit ”

The NWC National Secretary posites that there is a valid and subsisting Court Judgement against Chief Emeka Beke & Iheanyichukwu Azubuike, former Rivers State APC Chair and Legal Adviser, wherein they were removed from office.noting that the case suit No. PHC/ 925/CS/ 2023,Omiete Efrebo& 9 others Vs Chief Emeka Beke $ 2 others were removed from office, positing that the said judgement has been appealed against by Chief Emeka Beke which, he claimed is pending before the court of Appeal.

Barr. Festus maintained that the position of the National Working Committee is irreversible, pointing out that as far as the NWC is concerned , what happened was an abuse of power and of court processes and thus it would seek legal remedy against the judgement which reinstated Beke
